Terms of Use — BestInOnline

Welcome to BestInOnline. These Terms of Use ("Terms") form an agreement between you and Shutter Master LTD regarding the iOS application BestInOnline: AI Game Coach ("the App"). By installing or using the App, you agree to these Terms. If you disagree, do not use the App.

1. What the App does

The App helps you improve at multiplayer and competitive games by analyzing short gameplay videos with artificial intelligence and presenting coaching-style feedback. Features may include recording, trimming, AI reports, and local session history.

2. No multiplayer service between users

The App is not a matchmaking platform, guild tool, or messaging service. You do not share clips with other users through our systems, and we do not facilitate player-to-player data exchange. Any content you capture remains under your control unless you independently share it outside the App.

3. AI-generated coaching

Analysis is produced automatically by machine learning systems, including processing through FAL AI using the model nvidia/nemotron-3-nano-omni/video. Outputs are suggestions based on visual gameplay — not guarantees of rank improvement, tournament results, or in-game outcomes.

You are responsible for how you apply feedback. The App does not replace practice, team communication, or official game rules.

4. Your content and permissions

You retain ownership of gameplay videos you import or record. By submitting a clip for analysis, you grant us and our AI provider a limited license to process that video solely to generate feedback for you.

You confirm that:

You have the right to upload or record the footage;
Your clip does not violate third-party copyrights, privacy, or platform terms of the game publisher;
You will not submit illegal, abusive, or non-gameplay material.

5. Acceptable use

You agree not to:

Reverse engineer, scrape, or overload the App or connected APIs;
Use the App to harass others or distribute malware;
Misrepresent AI output as human coaching where prohibited;
Circumvent technical limits (such as clip length rules) in bad faith.

6. Third-party services

The App relies on partners including Singular (analytics/attribution), OneSignal (push notifications), and FAL AI (video inference). Your use of those features may be subject to their policies and availability. We are not responsible for third-party outages beyond our reasonable control.

7. Subscriptions and purchases

If the App offers paid features or subscriptions in the future, pricing and billing will be disclosed in-app and processed through Apple's App Store. Refunds follow Apple's standard policies unless otherwise required by law.

8. Intellectual property

The App, its design, branding, and original materials are owned by Shutter Master LTD or its licensors. Game titles, logos, and assets belonging to publishers remain their property. BestInOnline is not affiliated with or endorsed by any game publisher unless explicitly stated.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUT WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHUTTER MASTER LTD AND SUKHJINDER SINGH SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) TEN GBP (£10), IF YOU PAID NOTHING.

11. Indemnity

You agree to defend and indemnify us against claims arising from your misuse of the App, your uploaded content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the App at any time by deleting it. We may suspend or discontinue features if necessary for legal, security, or maintenance reasons. Sections that by nature should survive will remain in effect.

13. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Courts in England shall have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence.

14. Changes

We may update these Terms. Material changes will be reflected by updating the effective date. Your continued use constitutes acceptance.
